Privacy Policy

This policy explains what information Harbor Labs LLC ("Harbor Labs", "we", "us") collects through the WAKD iPhone app (the "App") and the website wakd.app (the "Site"), why, and what you can do about it.

The short version

  • Your alarms, settings and wake-up history live on your iPhone.
  • When an exercise uses the camera, video is analyzed on your iPhone and then discarded. No image or video ever leaves your device, and we never see it.
  • The App does not send us any personal information. It has no account, no analytics and no advertising.
  • We do not sell your personal information, and we do not use it to show you ads.
  • You can ask us for a copy of your data or to delete it at any time: support@harborlabs.io.

Harbor Labs LLC is the developer of WAKD and is responsible for your information (the "controller" under European data protection law).

Information the App collects

Stored only on your device

Your alarms (times, repeat days, sounds, labels), your chosen exercises and settings, and your wake-up history are stored on your iPhone using Apple's frameworks. We cannot access them. They are included in your device backups according to your iCloud settings, and they are deleted when you delete the App.

Camera

Some exercises ask for camera access so the App can count repetitions (for example, push-ups). Frames from the camera are processed in real time on your iPhone by an on-device pose-detection model to find body positions. Frames are not recorded, saved, or sent anywhere, and the App does not use the camera for anything else. You can turn camera access off at any time in Settings › WAKD; exercises that need it will then be unavailable.

Motion sensors

Some exercises read your iPhone's motion sensors to confirm you are moving. This data is processed on your device while the exercise runs and is not stored or sent anywhere.

Alarms and notifications

The App uses Apple's AlarmKit and notification frameworks to ring at the time you choose, including in Silent mode and Focus. This scheduling happens on your device. Apple's handling of this information is covered by Apple's Privacy Policy.

Collected by us or our providers

Nothing. No personal information is sent to us or to anyone else.

Information the Site collects

If you join the waitlist, we collect:

  • Email address, chosen language, approximate country (from your IP address) and sign-up time
    • Why: Telling you when WAKD launches and about major updates
    • Processed by: Cloudflare
    • Kept: Until you unsubscribe or ask us to delete it

Every email we send includes a way to unsubscribe, or you can email support@harborlabs.io.

The Site has no advertising, no analytics and no third-party trackers, and we set no cookies. If you pick a language, your choice is remembered in your browser's local storage, which stays on your device.

Our hosting provider, Cloudflare, processes your IP address and basic request details to deliver the Site and protect it from attacks, and may set a strictly necessary security cookie to block abusive traffic. These logs are kept for a short time and are not used to identify you.

How we use information

We use the information described above only to:

  • provide and operate the App and the Site;
  • email you about the launch and major updates, if you joined the waitlist;
  • answer your messages and support requests;
  • keep the App and the Site secure and comply with the law.

If you are in the European Economic Area, the United Kingdom or Switzerland, we rely on these legal bases:

  • Performance of a contract: to provide the App, the Site and features you request.
  • Consent: for the waitlist, and for device permissions such as the camera. You can withdraw consent at any time; this does not affect processing that already happened.
  • Legitimate interests: to keep the Site and App secure. You can object to this processing.
  • Legal obligation: where the law requires us to keep or disclose information.

How we share information

We do not sell personal information. We do not share it for cross-context behavioral advertising. We share information only with:

  • Service providers that process it on our behalf and under our instructions:

  • Apple: App distribution, payments, and the system alarm, camera and motion frameworks the app runs on. Privacy policy

  • Cloudflare: Hosting and protecting this website; storing waitlist sign-ups. Privacy policy

  • Authorities or others when the law requires it, or when it is needed to protect someone's safety or our legal rights.

  • A buyer or successor if Harbor Labs is involved in a merger, acquisition or sale of assets. This policy will continue to apply to your information.

How long we keep information

We keep information only as long as needed for the purposes above, as listed in this policy, and then delete or anonymize it. Information stored only on your device stays under your control and is removed when you delete the App.

International transfers

We and our providers may process information in the United States and other countries. When we transfer personal information out of the EEA, the UK or Switzerland, we rely on adequacy decisions or the European Commission's Standard Contractual Clauses (or their UK and Swiss equivalents).

Your rights

Depending on where you live, you may have the right to:

  • access the personal information we hold about you and get a copy of it;
  • correct it;
  • delete it;
  • object to or restrict how we use it, and withdraw consent;
  • receive it in a portable format;
  • complain to your local data protection authority.

To use any of these rights, email support@harborlabs.io. We will reply within 30 days and may need to confirm that the request comes from you. We will not treat you differently for using your rights.

Because the App keeps most data on your device, you can also delete it yourself by deleting the App.

California residents

The California Consumer Privacy Act (as amended by the CPRA) gives California residents the right to know, delete and correct personal information, and to opt out of its "sale" or "sharing". The categories we collect and why are listed above. We do not sell personal information. We do not "share" it as the law defines that term. We do not use sensitive personal information to infer characteristics about you. You may use an authorized agent to make a request.

Children

WAKD is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, contact support@harborlabs.io and we will delete it.

Security

We use reasonable technical and organizational measures to protect information, including encryption in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Changes to this policy

We will update this policy when our practices change. We will change the date at the top. If a change is significant, we will notify you in the App or by email before it takes effect.
